MRS Limited Warranty:

All repaired or replaced devices or components will be warranted for a period of one hundred and eighty days (180) days. If Your Device should malfunction, it must be returned to MRS for evaluation within one hundred and eighty (180) days from the date You were notified that Service was completed on Your Device. Any and all associated costs of shipping Your Device for repair shall be borne solely by You. MRS will diagnose the repair upon receipt. If, upon examination by MRS, Your Device is found to be defective due to the repair provided by or part purchased from MRS, Your Device will be repaired at no charge. This warranty does not apply to defects resulting from any action by You, including but not limited to mishandling, physical damage, water damage, improper interfacing, operation outside of design limits, improper repair by someone other than MRS, use of any other product other than MRS products, or unauthorized modification. This warranty is VOID if Your Device shows evidence of having been tampered with (broken seal) or shows evidence of being damaged as a result of: excessive corrosion; current, heat, moisture or vibration; improper specification; misapplication; misuse; abuse or other operating conditions outside of MRS’s control. MRS reserves the right to VOID its warranty if any improper software installations or modifications or upgrades have been made after customer has left the store location. This warranty is non-transferable and does not apply to any purchaser who bought the product from a reseller or distributor not authorized by MRS, including but not limited to purchases from internet auction sites. 

 

Limitation of Liability:

TO THE EXTENT PERMITTED BY LAW, THE EXPRESS WARRANTIES, CONDITIONS AND REMEDIES SET OUT IN THIS AGREEMENT ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, CONDITIONS, TERMS, UNDERTAKINGS, OBLIGATIONS AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, MRS SPECIFICALLY DISCLAIMS AND EXCLUDES ANY AND ALL STATUTORY AND IMPLIED WARRANTIES, CONDITIONS, TERMS, UNDERTAKINGS, OBLIGATIONS AND REPRESENTATIONS RELATED TO OR ARISING IN ANY WAY OUT OF THIS AGREEMENT, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, SATISFACTORY QUALITY, CARE, SKILL OR FITNESS FOR A PARTICULAR PURPOSE.

 

MRS DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR YOUR DEVICE NOT BEING AVAILABLE FOR USE, LOST PROFITS, LOSS OF BUSINESS, GOODWILL, OR FOR LOST, CORRUPTED, OR COMPROMISED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES. EXCEPT AS EXPRESSLY PROVIDED HEREIN, MRS WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. MRS WILL NOT BE LIABLE TO YOU IN ANY WAY FROM THE LOSS OR DESTRUCTRION OF YOUR DEVICE AS A RESULT OF CIRCUMSTANCES OUTSIDE THE DIRECT CONTROL OF MRS, INCLUDING WITHOUT LIMITATION: ACTS OF GOD, NATURE, WEATHER, FIRE, OR CRIMINAL ACTS OF THIRD PARTIES. IN NO EVENT SHALL MRS BE LIABLE FOR DAMAGES IN EXCESS OF THE TOTAL AMOUNT DUE FOR THE SERVICE.
